Florida Hasani – Kinderbetreuung
Legal

Terms and conditions

These general terms and conditions govern the childcare services that can be booked through this website.

Section 1 Scope and provider

(1) These terms and conditions apply to all childcare contracts between Florida Hasani, Legienstrasse 3, 51063 Cologne-Mülheim (the "provider"), and her customers (the "client") that are concluded via this website or following an enquiry submitted through this website.

(2) Only persons of full legal age who are legal guardians of the child or who are authorised by the legal guardians may act as clients.

(3) Deviating terms of the client do not become part of the contract unless the provider expressly agrees to their application in text form.

Section 2 Description of services

(1) The provider delivers childcare services. These include in particular supervising, occupying and supporting the children in an age-appropriate manner, as well as assistance with meals and everyday routines as agreed with the legal guardians.

(2) Care can be booked by the hour or as a package covering several hours or days. The exact scope and the agreed times follow from the respective booking.

(3) Depending on what is agreed, care takes place either in the client's home or at the provider's premises. The address of the place of care is agreed individually when booking.

(4) The services are provided personally by the provider. Substitution by third parties only takes place after prior agreement with the client.

(5) The contract does not cover educational support services in the sense of a day-care institution, private tutoring, nursing services in a medical sense, or household tasks going beyond those directly connected with the care of the child.

Section 3 Conclusion of the contract

(1) The presentation of the childcare services on this website does not constitute a binding offer, but a non-binding invitation to submit a booking enquiry.

(2) By submitting the completed booking form, the client makes a binding offer to conclude a childcare contract for the selected date.

(3) An online booking contract is concluded when full payment succeeds and the booking is confirmed in the system as part of that process. Confirmation is available through the protected booking status page. A separate acceptance by email is not required; the confirmation email documents the conclusion. A failure to send or receive the email does not undo a booking already confirmed. If the appointment is no longer available when payment is checked, or the booking was validly taken back or withdrawn beforehand, it will not be confirmed again; any amount received is clarified separately and refunded to the extent it is not owed.

(4) Before confirmation there is no entitlement to acceptance of a booking request. After conclusion, statutory rights and Section 8 of these terms apply to cancellations. Where care is arranged individually by email or telephone, scope, date, price and acceptance are expressly agreed personally; making contact alone does not create a contract.

(5) The applicable terms can be retrieved and saved before booking. Booking details and withdrawal information are sent with the confirmation email. The website does not offer separate retrieval of the complete historical contract text. The contract language is German; the English version is provided for information purposes.

Section 4 Prices

(1) The prices shown in the price table on the booking page at the time of booking apply (hourly rates and package prices).

(2) The provider is a small business owner within the meaning of Section 19 UStG. No value added tax is therefore charged or shown on invoices. All prices stated are final prices.

(3) Minimum booking: the minimum booking duration is two hours per assignment. If care is used for a shorter period, two hours are charged.

(4) Weekends and public holidays: on Saturdays, Sundays and public holidays (the statutory public holidays in North Rhine-Westphalia apply), the evening rate of EUR 45 per hour applies all day instead of the daytime rate. This surcharge also applies to day and multi-day packages: on these days the half day costs EUR 210 instead of EUR 140, the full day EUR 405 instead of EUR 270, and the long day EUR 485 instead of EUR 350. If a booked day within a multi-day package (3-day package, week package) falls on a Saturday, Sunday or public holiday, the difference between the standard full-day price and the weekend full-day price (EUR 135) is charged additionally for that day.

(5) Siblings: for each additional child from the same family cared for at the same time, the fee increases by EUR 15 per hour or by EUR 50 per day or multi-day package.

(6) If care is extended beyond the booked period at the client's request, the additional time is charged pro rata at the applicable hourly rate; part-quarter-hours are rounded up.

Section 5 Payment terms

(1) The fee, including any surcharges under Section 4, is payable in full in advance at the time of booking. Deposits or instalment payments are not offered.

(2) Payment is made online using the payment methods offered on the booking page, Stripe or PayPal. Payments are processed by the respective payment service provider under its own terms. Payment data are processed directly there (see the privacy policy).

(3) Before successful payment and booking confirmation there is only a provisional hold. It ends automatically 60 minutes after the unpaid request is created, without a further notice being required. Payment can only be started within the payment window indicated on the website. After successful confirmation, Section 3 (3) applies.

(4) Additional care time incurred under Section 4 (6) is invoiced after the appointment and is payable within seven days of the invoice date.

Section 6 Right of withdrawal for consumers

(1) Consumers (Section 13 of the German Civil Code, BGB) have a statutory right of withdrawal in accordance with the following withdrawal policy for childcare contracts concluded via this website or otherwise exclusively by means of distance communication (e.g. email or telephone).

Withdrawal policy

Right of withdrawal

You have the right to withdraw from this contract within fourteen days without giving any reason.

The withdrawal period is fourteen days from the day the contract is concluded, but does not begin before proper information about the right of withdrawal has been provided. The day triggering the period is not counted; the period ends at the end of the fourteenth following day. If its last day falls on a Saturday, Sunday or a public holiday at the relevant place of declaration or performance, it ends at the end of the next working day.

To exercise the right of withdrawal, you must inform us (Florida Hasani, Legienstrasse 3, 51063 Cologne-Mülheim, Germany, phone: +49 1578 5110135, email: willkommen@floridahasani.com) of your decision to withdraw from this contract by an unequivocal statement (e.g. a letter sent by post or an email). You may use the attached model withdrawal form, but it is not obligatory.

You can also exercise your right of withdrawal online using the "Withdraw from contract" button (German: "Vertrag widerrufen"), which is available in the footer of every page of this website. If you use this online function, we will send you an acknowledgement of receipt on a durable medium (e.g. by email) without delay, containing the content of your withdrawal declaration and the date and time of its receipt.

To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.

Effects of withdrawal

If you withdraw from this contract, we shall reimburse to you all payments received from you without undue delay and in any event not later than fourteen days from the day on which we are informed about your decision to withdraw from this contract. We will carry out such reimbursement using the same means of payment as you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of such reimbursement.

If you requested to begin the performance of services during the withdrawal period, you shall pay us an amount which is in proportion to what has been provided until you have communicated to us your withdrawal from this contract, in comparison with the full coverage of the contract.

Early expiry of the right of withdrawal

Your right of withdrawal expires early if we have fully performed the service and, before performance began, you expressly consented to us beginning performance of the service before the end of the withdrawal period and confirmed your acknowledgement that you will lose your right of withdrawal once we have fully performed the contract.

Consent to care starting early

(2) Before care actually starts within the withdrawal period, the client must expressly request that care begin early and acknowledge that the right of withdrawal expires on full performance. The booking process asks for this for short-notice appointments. Before care begins, the actual contract conclusion is used to check whether the required declaration is in place; if it is missing, it must be clarified personally before an early start. The passing of scheduled care time alone proves neither performance nor expiry of the right of withdrawal.

(3) Compensation following withdrawal requires the conditions of Section 357a (2) BGB, in particular an express request for an early start and proper information. It is calculated only for services actually provided up to withdrawal in relation to the agreed total scope. Scheduled periods or a technical booking status alone are not sufficient. Missing or disputed evidence is reviewed personally; receipt of the withdrawal declaration is unaffected.

The online withdrawal function and early-start declaration are in place. The effectiveness of a declaration does not depend on a subsequent email being sent. A required acknowledgement must be provided without delay on a durable medium; pending or uncertain message jobs are reviewed personally. SMTP acceptance alone does not prove receipt in the mailbox.

Section 7 Cancellation by the client

(1) Booked appointments can be cancelled at any time by email or through the website’s withdrawal and cancellation function. The relevant time is receipt of the declaration in relation to the agreed start of care. Mandatory statutory rights, in particular rights of withdrawal and termination, remain unaffected.

(2) Hourly bookings and single-day packages can be cancelled free of charge more than 48 hours before care begins. Amounts already paid are then refunded in full.

(3) Multi-day packages can be cancelled free of charge more than seven days before the first day of care. Amounts already paid are then refunded in full.

(4) In other cases, any claim for remuneration or loss is assessed individually under the statutory conditions and explained with its calculation. Saved expenses and other earnings that must be credited are deducted. The client remains free to establish that no claim or a lower claim exists. No fixed amount is automatically retained solely because of the time of cancellation. A replacement appointment can be agreed by mutual consent instead.

(5) Refunds are made via the same payment method used for the payment, as a rule within fourteen days. A review does not extend statutory refund periods.

(6) The consequences of a valid statutory withdrawal are governed exclusively by Section 6; no additional cancellation compensation is charged.

(7) A booking request that remains unpaid and has not been bindingly confirmed can be taken back free of charge. Receipt of the declaration is effective independently of subsequent payment or email processing.

Section 8 Cancellation by the provider, illness

(1) If the provider cannot keep an appointment due to illness or for other reasons for which she is not responsible, she will inform the client without undue delay. Amounts already paid are refunded in full or, on request, credited towards a replacement appointment. Further claims by the client, in particular for the cost of alternative childcare, exist only within the scope of Section 11 of these terms.

(2) If the child to be cared for falls ill, the client must inform the provider without undue delay. In the case of contagious illnesses — in particular fever, vomiting, diarrhoea or an illness notifiable under the German Infection Protection Act — care cannot take place. The cancellation terms under Section 7 apply to the cancellation of an appointment due to the child's illness.

(3) If a child falls ill during care or shows symptoms of illness, the provider will inform the client immediately. The client must be reachable during the care period and must collect the child, or arrange for collection, promptly in such a case. Care time already begun will be charged.

Section 9 Client's duties to cooperate

The client undertakes:

  • to provide all information essential for safe care before care begins, in particular on allergies, intolerances, chronic illnesses, required medication and the child's special needs,
  • to name at least one reachable emergency contact and to be reachable by phone personally during the care period,
  • to state which persons are authorised to collect the child,
  • to provide a safe care environment as well as the necessary items, food and a change of clothes,
  • to hand over the child punctually at the agreed start of care and to take the child back at the agreed end.

Medication is administered exclusively on the basis of a separate written agreement stating the exact preparation, dosage and time.

Section 10 Duty of supervision

(1) The duty of supervision over the child passes to the provider upon the actual handover at the start of care and ends when the child is returned to the client or to a person authorised by the client to collect the child.

(2) The extent of supervision depends on the age, stage of development and individual character of the child as well as on the particular circumstances. Outings, car journeys, visits to swimming pools and comparable activities only take place after prior agreement.

Section 11 Liability and insurance

(1) The provider is liable without limitation for damage arising from injury to life, body or health and for damage based on intent or gross negligence.

(2) In the case of slightly negligent breach of a material contractual obligation whose fulfilment makes the proper performance of the contract possible in the first place and on whose observance the client may regularly rely, liability is limited to the foreseeable damage typical of this type of contract. Otherwise, liability for slight negligence is excluded.

(3) The provider is liable for damage caused by the child in her care to third parties only in the event of a culpable breach of her duty of supervision.

(4) The liability rules in paragraphs 1 and 2 also apply to valuables brought along.

Section 12 Force majeure

If care cannot take place due to circumstances for which neither contracting party is responsible (in particular natural events, official orders or epidemics), both parties are released from their performance obligations. Amounts already paid are refunded; no further claims exist.

Section 13 Data protection and confidentiality

(1) The processing of personal data is governed by the privacy policy of this website.

(2) The provider treats all personal and family circumstances that become known to her in the course of care as confidential. Photos or videos of the child are taken only with the express prior consent of the legal guardians and are never published without separate consent.

Section 14 Final provisions

(1) The law of the Federal Republic of Germany applies. Mandatory consumer protection provisions of the state in which the client has his or her habitual residence remain unaffected.

(2) Amendments and supplements to the contract must be made in text form.

(3) The provider is neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.

(4) Should any provision of these terms be or become invalid, the validity of the remaining provisions remains unaffected. The statutory provisions take the place of the invalid provision (Section 306 BGB).
